ACT+EARN Privacy Policy

ACT AND EARN, LLC and the ACT+EARN app are dedicated to providing a safe and secure online environment for parents and children. 


We are committed to protecting the privacy of our users, especially children, and complying with established data security frameworks inclusive of guidelines as related to COPPA (Children's Online Privacy Protection Act) laws.


The following Privacy Policy provides an overview of interactions between ACT+EARN and your data, behind intent of maintaining privacy and data security within such usage.


Collection of Information

Within intention toward least necessary, ACT+EARN will collect limited personal information from users, such as email addresses for account creation and communication purposes. For children under the age of 13, we may collect a parent's email address for parental consent.


Types of Information Collected and Used by ACT+EARN

Personal Data

While using ACT+EARN, you may be asked to provide certain personally identifiable information.  The information provided may be applied toward user-elected communications:

  • Email address
  • First and Last Name
  • Phone make, model and software
  • State of residence
  • Birth year
  • Postal Code of residence
  • Application usage data

Usage Data and Non-Personal Information

Using the ACT+EARN service, as with any website or application, collects data automatically. 

Usage data may include information including the Internet Protocol address (i.e., IP address) of your device and basic system information to aid app functionality such as browser type, browser version, pages visited within ACT+EARN, the date and time of those pages visited, time spent on those respective pages and other diagnostic data.


When ACT+EARN is used via a mobile device, information to aid the performance of the service may be collected automatically that includes, but is not limited to, the type of device used, mobile device unique ID and IP address, device operating system, type of mobile internet browser, information sent by your browser when accessing the service and other diagnostic data.


Account Creation, Account Access and Third-Party Services

ACT+EARN allows user account creation and login through third-party social media services including:

  • Apple
  • Google
  • Facebook
  • Twitter / X

Accounts created and accessed through these third-party services grant access that may include the collection of personal data already associated with your third-party account which, relevant to the social media account, may include name, email address, activities or contact list associated with that account.


By interfacing with ACT+EARN through your third-party social media services account during or following registration, you are granting permission for related information and Personal Data use and storage in manner consistent with guidelines established by this Privacy Policy.


Information Collection Through Application Usage

Through permissions granted in creating an ACT+EARN account, information may be collected in support of providing certain app features, which may include pictures and information from the camera and photo library of the device used to access ACT+EARN.  Granted access to the camera and photo library is at all times elective, where information and images provided are used in support of account features including avatar creation or upload of visual evidence related to the completion of tasks or assignments.


Additionally, information collected in use of the ACT+EARN service, improving upon or customizing the service may be stored on ACT+EARN servers or Third-Party Social Media provider servers if used for account creation and login or stored within your device.


The access granted can be amended, enabled or disabled at any time through your device settings.

Tracking and The Use of Cookie Technology

ACT+EARN reserves the right to employ the use of cookies as a tracking technology of activity within the application, stored and used for the purpose of analyzing user behavior behind improving application functionality and the experience of our users. 


Tracking and Cookie Technologies Used May Include:

Cookies: A cookie is a small file placed on your device, where by election you may choose to refuse or accept all.  A choice of not accepting all cookies may, however, cause certain aspects of ACT+EARN not to function as designed.


Beacons (or pixel tags): Both ACT+EARN and selected communications associated may contain small files that allow recording of performance and usage analytics.  These files are sometimes known as clear or single pixel gifs or tags.


Use of Your Personal Data

The Personal Data in association with use and user accounts of ACT+EARN is applied for the following purposes:


  • To maintain the continuity of ACT+EARN, along with usage of the platform.
  • To manage user accounts and the functionalities granted to each user based upon both elective data provided and cookies accepted.
  • To fulfill the delivery of services to users through purchased subscriptions and/or trial periods, as assurance for the development and compliance of the ACT+EARN service.
  • To communicate with ACT+EARN users, as elected, by email, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or communications related to the functionalities or account services, including security updates, when necessary, as related to implementation.
  • To manage your account and requests as related made to ACT+EARN
  • For use by ACT+EARN in performing data and performance analytics as related to evaluating usage and determining improvements to the user experience and effectiveness of upgrades and/or campaigns.
  • For use, in parallel with the intent of ACT+EARN privacy policy, in sharing with Affiliates or partners aligned with the ACT+EARN app.

The information we collect is used solely for providing and improving our app's services. We do not sell or share personal information with third parties.


Retention of Your Personal Data

ACT+EARN will retain your Personal Data only for a period as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to adhere with legal requirements, disputes, and enforce our legal agreements and policies. 


Usage data as related to ACT+EARN will be retained for internal analysis purposes.  While the retention period of usage data is a shorter period of time, applications can include insights to yield improvements in service functionality or for analysis focused on security posture improvements. 


Transfer of Your Personal Data

Your information and Personal Data are held in accordance with all applicable and current standards of physical and cloud information technology security.   As with any cloud storage, the physical location of data centers and cloud servers within may be located outside of your region and state.  


Your Personal Data, therefore, may reside in a region or state where facilities whose equipment is owned or leased by ACT+EARN are subject to laws that differ from your state of residence.  

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.


ACT+EARN will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place unless there are adequate controls in place including the security of your data and other personal information.


Data Sharing and Disclosure

ACT+EARN will not sell or rent your personal data. However, in the course of providing the service, we may share your information in the following circumstances:

With Service Providers and Partners

ACT+EARN may share your personal data with trusted third-party service providers who assist us in operating our application and providing services to you. These include cloud storage and hosting providers, payment processors, customer support and communication tools, analytics and performance monitoring services and, though only where applicable and with your election and consent, marketing and advertising partners. These third parties are contractually obligated to protect your data and use it only for the specified purposes.


For Legal Compliance and Security

ACT+EARN may disclose your personal data if required to do so by law or in response to valid legal requests, which might include: compliance with legal obligations, court orders, or regulatory authorities, protecting the rights, safety, and security of our users, our application, or the public, or in the course of Investigating and preventing fraud, abuse, or unauthorized activities.


In Business Transfers

Should ACT AND EARN, LLC undergo a merger, acquisition, sale of assets, or other business transaction, your data may be transferred as part of that process. We will notify you if such a transfer occurs and outline your choices regarding your data.


With Your Consent

ACT+EARN may share your personal data with third parties when you explicitly consent to such sharing, such as when integrating with third-party services or participating in promotions. 

Aggregated or Anonymized Data

ACT+EARN may share non-personally identifiable data in the form of collective analytics, for example, with partners, advertisers, or research institutions for business insights, trends analysis, and service improvements.

We take the security of your personal data seriously and implement appropriate technical and organizational measures to safeguard it. These measures include:

Data Encryption

We use industry-standard encryption protocols (such as SSL/TLS) to protect data in transit between your device and our servers.  Sensitive data, such as user passwords, is securely encrypted at rest.  Payment information for subscriptions to the ACT+EARN platform are handled outside of ACT+EARN and only by industry-leading payment processing services.


Access Controls and Authentication

ACT+EARN implements a strict set of access controls to ensure that only necessary and authorized personnel can access personal data. Multi-factor authentication (MFA) is used where applicable to enhance account security.

Secure Storage and Data Minimization

We store the Personal Data our account users within the established security measures as in use by top-tier cloud storage solution providers and in accordance with industry-standard security frameworks. ACT+EARN will collect and retain only the necessary personal data required to provide our services.


Regular Security Audits and Security Monitoring

We conduct regular security assessments, vulnerability scans, and penetration testing to identify and mitigate potential risks.  Our systems are continuously monitored to detect and prevent unauthorized access, breaches, or suspicious activities.


Incident Response and Data Breach Notification

In the event of a data breach, we have a response plan in place to minimize impact and notify affected users in compliance with legal requirements.  Where required, we will report security incidents to relevant data protection authorities and impacted individuals.


User Responsibilities

While we take strong security measures, users also play a role in protecting their accounts. We encourage you to use strong, unique passwords and enable security features such as two-factor authentication (2FA) where available.


COPPA Compliance

ACT+EARN maintains strict compliance with COPPA regulations and at no time will knowingly collect personal information from users under the age of 13 without first obtaining and verifying parental consent.


Parental Controls

Within the ACT+EARN platform, the parent, guardian or responsible adult (“Parent”) must initiate account creation. Only a Parent will have the ability to review, edit, or delete their child's personal information stored in our app. A Parent may, at any time, as well contact ACT+EARN to request the removal of their child's information via e-mail: [email protected]


Changes to Privacy Policy

We reserve the right to update our privacy policy to reflect changes in our practices or legal requirements. Users will be notified of any significant changes.
